The Florida Statutes provide for this and until our HOA friendly legislators decide to do something to protect our property rights, we're stuck with this unfair system.<br /><br />Even the appellate courts have recognized the system is unfair and the payoff amount "becomes a moving target" with every attempt to communicate with the association attorneys to resolve the matter generating more fees.
